Sir Rod Stewart and his son Sean are set to face a civil suit after allegedly "punching a security guard" in Florida.

The singer and his son were first charged by police after the alleged incident.

An official report stated that an incident occurred after the singer and his friends, including his son Sean, weren't allowed in to a private event on New Year's Eve.

Sean is alleged to have pushed the security guard, before Sir Rod hit his chest "with a closed fist".

Both family members have been ordered to appear at the Palm Beach County Criminal Justice Complex on February 5 on charges of "misdemeanour battery".

Jessie's lawyer Gawayne Kelly also confirmed to The Scottish Sun that he was pursuing a separate civil case for damages.

Gawayne said: "We are going to come from a civil point of view. There’s a criminal case which we’re not involved in."

Sir Rod, 74, told police that Jessie became argumentative with his group, causing his family to feel "agitated".

The rock star later apologised for his part in the incident.

Sean told TMZ: "I’m not allowed to make a comment, but I will say this: my dad always taught me to stick up for my family and my loved ones, and that’s what I did, and the truth will prevail. He [Jessie] was being very aggressive, that’s all I can say."
